PRIVACY POLICY

This privacy policy, including our Notice of Privacy Practices (collectively, this “Policy”) explains how personal information is collected, used, and disclosed by Acuity Link LLC (“Acuity Link” or “we”). This Policy applies to users (individually referred to as “you”) of Acuity Link’s websites and applications (together, our “Sites”) and the services provided through such websites and applications (Services).

Other third parties, such as healthcare institutions, ambulance services, medical transport companies and vendors that you engage with through our Sites and Services may also collect, use, and share information about you. In certain cases, you or other third parties may disclose individually identifiable health information (“PHI”) to us or allow us to create or receive PHI on your or their behalf. We are committed to legally and appropriately safeguard the PHI that we receive in compliance with the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”). You should feel secure in knowing that Acuity Link does not sell or share personal information outside of Acuity Link except as permitted by law or as specifically authorized by you. We do not collect any “personally identifiable information (PII),” about you, except for the information that you provide to us in order to establish a user account. Any and all such information collected by us is used for our internal business purposes only. The only exception to this occurs when you give us your consent to share your information, when we need to share your information to provide a service that you have requested, or when we are required by law to disclose information. You will not receive e-mail as a result of visiting our site unless you request it.

INFORMATION WE COLLECT

We collect information about you in various ways when you use our Sites. We use this information to, among other things, provide the Services, improve the functionality and quality of our Sites and personalize your experience. For example, we may collect your name, e-mail address, birthday, postal address, phone numbers, billing information, demographics, current and prior medical transport transaction details, preferred health professionals and healthcare institutions, special requests and preferences, passwords, contact information of people you add to, or notify of, medical transport services through our Sites, and other information you provide on our Sites or in connection with the Services. If you use our mobile application, we may also collect your mobile device ID, your precise location data, and the search locations you select. We may also obtain information from other sources, such as third party websites, applications and services (each, a “Third Party Platform”), through which you connect with our Sites or Services and combine that with information we collect on our Sites or through our Services.

When you visit our Sites, some information is automatically collected. This information is used only to help us improve the design and functionality of the Sites and ensure proper use and provision of the Services. For example, we may automatically collect your location, computer operating system, Internet Protocol (IP) address, access times and browser type and language. We also collect information about your usage and activity on our Sites using certain technologies, such as:

  • We may automatically collect information using “cookies” and similar technology. Cookies are small data files that may have unique identifiers and reside, among other places, on your computer or mobile device, in e-mails we send to you, and on our web pages. Among other things, cookies help us improve our Sites, our Services and your experience. We use cookies to see which areas and features of our Sites and Services are popular and to count visits to our Sites and data about our Services. We may access information contained in cookies placed on your device by a Third Party Platform as permitted by the terms of your agreement and privacy settings with such Third Party Platform. We may share this information with the Third Party Platform for its use as permitted by the terms of your agreement and privacy settings with such Third Party Platform.
  • Web Beacons. We may collect information using web beacons. Web beacons are electronic images that may be used on our Sites or in our e-mails. We use web beacons to deliver cookies, count visits and understand usage and tell whether you open an e-mail and act upon it.

If you are not a registered user of our Services, you may browse our Sites anonymously by choosing not to provide us with any PII such as your name or e-mail address, or choosing not to register during your visits to our Sites. When you browse this way, we will not link your online activity with the accounts you may have with us.

HOW WE USE INFORMATION WE COLLECT

If you choose to provide us with PII over the Internet, such as by using our Services or signing up for e-mails from Acuity Link, we collect the information that you provide to us. We use personal information collected through our Sites and Services for the purposes described in this. For example, we may use your information to:

  • inform you about products and services that may be of interest to you;
  • e-mail medical transport scheduling data to designated partners;
  • operate and improve our Sites and Services;
  • understand you and your preferences to enhance, personalize, and customize your experience using our Sites and Services such as understanding your medical transport needs and history to make recommendations to you;
  • process and deliver data analytics based on use of our Services;
  • respond to your comments and questions and provide customer service;
  • send you information relating to our products and services, including reservation confirmations, receipts, technical notices, legal notices, updates, security alerts and support and administrative messages;
  • communicate with you about offers, upcoming events and other news about products and services offered by Acuity Link, our subsidiaries and affiliates and other selected partners;
  • authenticate your identity, location, subscription status and/or account information; and
  • protect, investigate, and deter against fraudulent, unauthorized, or illegal activity.

By providing your mobile phone number, you expressly consent to receive direct dial calls, autodialed and prerecorded message calls, and text messages from us relating to our products and services at that number, all in accordance with applicable law.

Information Shared With Healthcare Institutions and Medical Transportation Companies

When you use the Services through our Sites, your information is provided to us and to the institutions and companies your activity affects. In order to provide the Services, your information is provided to the other party, just as it would if you made a called or e-mailed such party directly or used such party’s website. If you provide a mobile phone number, you may receive text messages regarding your use of the Services. When you use the Services through our Sites we may also share with the provider additional information, such as information about your prior use of the Services or information that we collect via Third Party Platforms. You may also have the option of indicating special preferences or providing comments about your reservation that Acuity Link will pass on to that provider.

Information you choose to share with a provider when you use the Services through our Sites may be used by the provider for its own purposes. Acuity Link does not control, and is not responsible for, the privacy practices of providers. Please contact the relevant provider directly if you want to learn about its privacy practices.

Sharing with Others

We do not share your personal information or the PHI we receive from you with third parties other than as described above, in our HIPAA Notice of Privacy Practices https://www.acuity-link.com/Privacy and as follows:

  • We may share personal information with affiliates, third party vendors, consultants, and other service providers who work for us. Such third party vendors may include vendors who provide fraud detection services to us and other third parties.
  • We may share statistical or analytical data for the improvement of services offered by our Sites.
  • We may disclose your personal information (i) to comply with laws and to respond to lawful requests and legal process, (ii) to protect the rights and property of Acuity Link, our agents and customers, and others, including to enforce our agreements, policies, and terms of use, and (iii) in an emergency to protect the personal safety of Acuity Link, its customers, or any person.
  • We may disclose or transfer your personal information to a third party if we sell, transfer, divest, or disclose all or a portion of our business or assets to another company in connection with or during negotiation of any merger, financing, acquisition, bankruptcy, dissolution, transaction, or proceeding.

SECURITY OF YOUR PERSONAL INFORMATION

Acuity Link takes reasonable steps to help protect your personal information and the PHI you may transmit to us when using the Services in an effort to prevent such information’s loss, misuse, unauthorized access, disclosure, alteration, and destruction. When you transmit PHI to, or through, our Sites, it will be protected by encryption technology, such as Secure Sockets Layer (SSL).

You may opt out of receiving promotional e-mails from Acuity Link by following the instructions in those e-mails. If you opt out, we may still send you non-promotional e-mails, such as e-mails about your Acuity Link account or our ongoing business relations. You may also send requests about your contact preferences or changes to your information, including requests to opt out of sharing your personal information with third parties, to us using the contact information below.

Cookie Choices

Most web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Sites.

Application Location Choices

NOTICE REGARDING PERSONAL HEALTH INFORMATION

NOTICE TO CALIFORNIA RESIDENTS

Your California Privacy Rights (As Provided by California Civil Code Section 1798.83)

A California resident who has provided personal information to a business with whom he/she has established a business relationship for personal, family, or household purposes (a “California Customer”) may request information about whether the business has disclosed personal information to any third parties for the third parties’ direct marketing purposes, subject to certain exceptions. In general, again, subject to certain exceptions, if the business has made such a disclosure of personal information, upon receipt of a request by a California Customer, the business is required to provide a list of all third parties to whom it disclosed personal information in the preceding calendar year, as well as a list of the categories of personal information that were disclosed. One of the exceptions allows Acuity Link to provide California Customers a cost-free means to opt out of these disclosures instead of providing such list. Any customer may request to opt out of these disclosures by contacting Acuity Link as described above. California Customers may also request further information about our compliance with this law by contacting us at our address above.

CHILDREN

Acuity Link is committed to protecting children’s privacy, particularly in their online interactions. Our Sites and Services are subscription based and not designed for and do not intentionally target or solicit to children 18 years of age and younger. CHANGES TO THIS POLICY

Acuity Link may update or revise this Policy from time to time. You agree that you will review this Policy periodically. If we make any changes to this Policy, we will change the “Last Updated” date above. You are free to decide whether or not to accept a modified version of this Policy, but accepting this Policy, as modified, is required for you to continue using our Sites. If you do not agree to the terms of this Policy or any modified version of this Policy, your sole recourse is to terminate your use of our Sites.
